Before Using Audio Sources (Music & Sound Effects)

1. Please be sure to read this document before using any audio sources on this site (hereinafter "audio sources").

2. By using the audio sources, the user is deemed to have agreed to this audio source usage license (hereinafter "this License").

3. The site's Terms of Use also apply to use of the site and audio sources; please be sure to review the Terms of Use.

Preconditions

1. No royalties or other usage fees will be charged for the use of the audio sources.

2. Users are not required to display copyright notices or credits when using the audio sources.

*The rights to the audio sources are held by the composer/creator of each audio source, who publishes them under their responsibility.*

3. In addition to this License, composers/creators may impose separate usage conditions. In such cases, the composer/creator's conditions take precedence, and this License applies to items not expressly specified otherwise.

*However, the preconditions "1" and "2" above and the "Prohibited Uses" described below shall take precedence over any composer/creator conditions.*

Warranty for Audio Sources

Audio sources on this site are published on the condition that the composer meets the following terms under the site's composer participation rules.

1. They own all rights to the audio source, including copyright, moral rights, and neighboring rights.

2. They have not entered into exclusive writer contracts, copyright assignment contracts, management or representation contracts, etc., with specific music publishers, record companies, production companies, or copyright management organizations concerning the audio source.

3. If publishing a cover or arrangement of an existing song, the original song's copyright has already expired and it is in the public domain.

4. They have not transferred rights in the audio source to a third party, nor set exclusive licenses.

5. If rights to the audio source are shared with third parties, they have obtained permission from all rightsholders to publish on this site.

6. There are no impediments to providing, publishing, and licensing the audio source to users as material on this site under this License.

Scope of the License

1. Subject to this License and any composer/creator-imposed conditions, users—whether commercial/non-commercial and individual/corporate—may use the audio sources in any works in the following ways.

(a) Use as background music

"Use as background music" in this License means using the audio source as background (secondary) to some other primary content. If the audio source is used as the primary element rather than background (hereinafter "Uses Outside License"), it falls outside the scope of this License except in the cases listed in (b) below. See Examples of Background Music Use, Prohibited Uses, and the FAQ for details.

(b) Use in musical works

"Use in musical works" in this License means producing a musical work that is based on the audio source and the composition to which it pertains (hereinafter "musical work") and that satisfies both ① and ② below. ① Adding musical creativity to the audio source or its composition—for example, covers, arrangements, adding vocals, or sampling to create a new song. ② Distributing the musical work on user-generated content free-to-view Internet services (including YouTube, TikTok, etc., hereinafter "UGC services"). Distribution, sale, or public performance on media other than UGC services is prohibited (this includes distribution on Apple Music, Spotify, registration with music recognition services like Shazam, distribution as BGM materials, sales of tangible items such as CDs or music boxes, etc., but is not limited to these).

2. Users may process (edit, apply effects, fade in/out, etc.) the audio sources.

3. Even after an audio source is removed from this site, users who downloaded the audio source from this site may continue to use it under this License.

Examples of Background Music Use

  • Use in TV programs and commercials
  • Use in stage productions (plays, readings, etc.)
  • Use in submissions to video contests
  • Use for school assignments
  • Use in online video/content distribution such as YouTube, TikTok, Twitch, IRIAM, podcasts, and other online videos/content

*However, broadcasts where the audio source is the main content, such as "music-for-workout BGM" or web radio primarily introducing music, are considered Uses Outside License.*

  • Use in live broadcasts, radio, and other live content

  • Use in stores, weddings, and other events

*Please download the audio source once and use it via external media (burn to CD, use on PC/mobile devices, MP3 players, etc.).*

  • Use in paid or free apps (iPhone, Android, etc.) and web services

*This License targets primary users who use the audio sources to create works as described in "Scope of the License"; it does not apply to tool apps or platforms. For embedding into tool apps/platforms and licensing to their users (secondary users), please consult site management in advance.*

  • Use in paid or free products/works (games, DVDs, etc.)
  • Use in presentation videos/materials created with software such as Microsoft PowerPoint

Examples of Processing

Users may perform the following processing on audio sources.

  • File format conversion (e.g., mp3 → wav/ogg, etc.)
  • Applying effects to audio sources (distortion, pitch shift, etc.)

*However, processing that significantly diverges from the original audio source or is judged to severely damage its evaluation is prohibited.*

  • Editing such as cutting the intro, extracting needed parts and creating loops, etc.

Prohibited Uses

The following uses and methods of using audio sources are prohibited.

1. Use of audio sources in works or content that violate laws (Japanese law) or public order and morals.

2. Use of audio sources in political, religious, or other ideological works or content.

3. Using audio sources in musical works in a manner that does not meet the license scope defined in Use in musical works.

(Example of failing to meet ①) Using the audio source or its composition without adding musical creativity—distributing mix-adjusted versions, loop versions, collections of music-for-work, etc. (Example of failing to meet ②) Distribution, sale, or public performance on media other than UGC services (including distribution on Apple Music or Spotify, registration with music recognition services like Shazam, distribution as BGM materials, sales of tangible items like CDs or music boxes, etc., but not limited to these.)

4. Beyond the provisions above, using all or part of the audio source and its composition in musical works in a manner that exceeds the license scope defined for "Use in musical works."

5. Publishing videos or other content where the audio source is the main content (without added value), such as "music-for-work BGM," "healing music," or web radio primarily introducing music.

6. Using audio sources in products, works, apps, or other creations whose primary purpose is to let end users listen to the audio source or whose main function is only to play the audio source.

7. Distributing or selling the audio sources—whether or not composer/creator credit is displayed or misattributed, and whether commercial or non-commercial.

*This applies to any method that allows end users to use the audio source alone, regardless of format, including open/closed internet publication or distribution on media such as CDs.*

8. Using audio sources in a state where end users can easily access and duplicate the audio files as audio files without conversion.

9. Public performance of the audio sources such as live performances (including publishing recordings or videos of performances using the audio sources).

10. Creating and publishing/selling sheet music of the audio sources. However, this does not apply if the site management agrees otherwise.

11. Using audio sources to train AI.

12. Using audio sources in ways that are judged to damage or potentially damage the composer/creator's honor or reputation.

13. Registering the audio sources, the compositions to which they pertain, musical works, or other creations (whether within or outside this License's scope) with copyright management organizations such as JASRAC.

14. Registering the audio sources, the compositions to which they pertain, musical works, or other creations (whether within or outside this License's scope) in fingerprinting systems on UGC services or other platforms (on YouTube this is called Content ID, but not limited to that).

If audio source use is judged to violate this License or composer/creator conditions, a copyright holder (or agent) may file a copyright infringement claim. If a "copyright infringement claim" is filed for use on YouTube, please refer toUsing on YouTube.

Other

1. We cannot respond to individual permission requests, judgments, or inquiries regarding the intended use of audio sources. Please refer to this License and the FAQ and make your own judgment under your responsibility.

2. If a "copyright infringement claim" is made for use on YouTube, please refer to Using on YouTube.

3. For details on permitted uses of audio sources, please refer to the FAQ.

Disclaimer

1. Except in cases of willful misconduct or gross negligence, the site and composers/creators shall not be liable for any troubles arising from the use of the site's content (music, sound effects, pages, etc.).

2. The site's content (music, sound effects, pages, etc.) may be changed or deleted without notice. The site may also be closed at its convenience.
